El recurso de control de legalidad en la Ley Orgánica Procesal del Trabajo

La presente investigación tiene como propósito analizar la efectividad del Recurso del Control de la Legalidad establecido en la Ley Orgánica Procesal del Trabajo, dividiéndose el trabajo en cuatro capítulos, desarrollando el Capítulo I, las definiciones y requisitos establecidos en la Ley Orgánica Procesal del Trabajo, y en la Jurisprudencia de la Sala de Casación Social del Tribunal Supremo de Justicia, para interponer el recurso del control de la legalidad. El capítulo II, analiza el recurso del control de la legalidad como sustento de la aplicación de la justicia y la tutela judicial efectiva. El capítulo III, contiene su naturaleza jurídica, la facultad discrecional de la Sala de Casación Social para admitir o negar el recurso; así como el análisis de la sentencia que desaplica el artículo 177 de la Ley Orgánica Procesal del Trabajo. El capítulo IV, establece las bases legales en que se fundamenta el mismo. Finalmente se establecieron las conclusiones y reflexiones a las que arribo la investigación, siendo una de ellas, la de sugerir una revisión del Capitulo VII de la Ley Procesal Laboral, que consagra el recurso del control de la legalidad, a los fines de que sirva como mecanismo para alcanzar la justicia y la tutela judicial efectiva, y por ultimo se hizo referencia a las fuentes consultadas. This research aims to analyze the effectiveness of the Resource Control Legality established in Labour Procedure Law, dividing the work into four chapters, Chapter I developed the definitions and requirements of the Labour Procedure Law, and in the Jurisprudence of the Social Chamber of the Supreme Court, to appeal the legality control. Chapter II discusses the use of control of legality as support the implementation of justice and an effective remedy. Chapter III contains the legal nature of the discretion of the social hall to admit or deny the appeal, and the analysis of the sentence that disengages Article 177 of the Labour Procedure Law. Chapter IV provides the legal basis on which it is based. Finally settled conclusions and reflections on the research he arrived, one of them, to suggest a revision of Chapter VII of the Labour Procedure Act, which enshrines the appeal of the legality, in order to serve as mechanism to achieve justice and an effective remedy, and finally referred to the sources.
