The objective of this research work is to determine if the performance of the written evidentiary
activity by the legal operators in the contentious administrative labor process significantly
violates the right to effective jurisdictional protection of the files seen in the second and fifth
specialized labor court. of the Superior Court of Justice of La Libertad during the years 2015 to
2018, demonstrating that the test is operated in an improper manner, showing as a consequence
long terms to issue a sentence in the processes.
From the analysis of the 40 contentious administrative labor processes, in 72% the evidentiary
activity was limited only to the actions of the previous administrative procedure; in 25% during
the procedural phase, the judge rules out the use of additional evidence (ex officio evidence)
and; in none of the processes during the procedural phase was untimely evidence exceptionally
presented.
Concluding that the written evidentiary activity in the contentious administrative labor process
significantly violates the right to effective jurisdictional protection, because the legal operators
act improperly in the performance of the evidence, showing extensive terms to issue a sentence
in the processes, demonstrating that in review-only function prevails in most processes.
