La tesis titulada: “INCONSTITUCIONALIDAD DE LA TASA DE SEGURIDAD
CIUDADANA POR LA MUNICIPALIDAD PROVINCIAL DE TRUJILLO”, pretende dar a
conocer si el cobro de la tasa de seguridad ciudadana por parte de la Municipalidad Provincial
de Trujillo es Inconstitucional, determinar cuáles serían las causas de inconstitucionalidad; así
como, si existe alguna normativa para la creación de la tasa de seguridad ciudadana, debido a
que en la actualidad existe la Policía Nacional de Perú, que es la institución que se encarga de
mantener el orden interno, así como también se encuentra al servicio de las autoridades de
gobierno y de la población en general.
Esta investigación, también realiza un análisis entre las funciones que en la realidad cumple el
servicio de seguridad ciudadana de la municipalidad provincial de Trujillo y las funciones que
desempeña la Policía Nacional de Perú, llegando a la conclusión que la autonomía otorgada a
las municipalidades no les faculta para intervenir en hechos de violencia o actos que constituyen
delitos y atentan contra el orden interno la paz y la tranquilidad; debido a que la Policía es la
encargada de mantener el orden interno, y para ello la Policía cuenta con un presupuesto propio
que el gobierno les asigna anualmente para el cumplimiento de sus funciones. The thesis entitled: "UNCONSTITUTIONALITY OF THE CITIZEN SECURITY TAXES BY
THE PROVINCIAL MUNICIPALITY OF TRUJILLO", intends to make known if the
collection of the citizen security taxes by the Provincial Municipality of Trujillo is
unconstitutional, to determine which would be the causes of unconstitutionality; also whether
there are regulations for the creation of the citizen security taxes, due to the fact that there is
currently the National Police of Peru, which is the institution in charge of maintaining internal
order, as well as being at the service of government authorities and the population in general.
In addition, this research analyzes the functions that the citizen security service of the provincial
municipality of Trujillo actually performs and the functions of the National Police of Peru,
concluding that the autonomy granted to municipalities does not empower them to intervene in
acts of violence or acts that constitute crimes and threaten internal order and peace, because the
police are responsible for maintaining internal order, and for that purpose the police have their
own budget, which the government allocates to them annually for the performance of their
duties.
