Colisión de la ley penal y la costumbre en los delitos de violación sexual a menores de edad cometidos por los integrantes de las comunidades nativas de la cuenca del río amazonas

En este trabajo de investigación se ha estudiado, el delito de violación sexual de menores de edad, el marco legal que lo penaliza y su aplicabilidad a los varones integrantes de las comunidades nativas de la cuenca del río Amazonas del Perú, tomando en consideración sus costumbres ancestrales. Se elaboraron diversos instrumentos para el recojo de datos tales como: hojas de registro, fichas y cuadernillos de encuestas. Se realizaron visitas a las Comunidades Nativas de Loreto y San Martín para recolectar datos sobre sus costumbres ancestrales incidiendo en la edad de iniciación y convivencia sexual de las mujeres nativas con los varones de su comunidad, así como, sobre la edad a la que empiezan a procrear hijos. También se recolectaron datos de las Cortes Superiores de Justicia de Loreto y La Libertad sobre los procesos penales seguidos a los miembros de las comunidades nativas y a los de la cultura mayoritaria mestiza, por la comisión del delito de violación sexual de menores de edad. Para el análisis y presentación de datos se empleó tablas de frecuencia y gráficos de barras. Se ha corroborado, entre otras cosas, que la ley penal, al no tener en cuenta la multiculturalidad e interculturalidad de la población peruana, colisiona con las costumbres ancestrales que rigen la vida de los nativos de las comunidades de la cuenca del río Amazonas. En consecuencia, existe la urgente necesidad de elaboración y promulgación de un Código Penal Especial.
