Vulneración a la protección especial de la trabajadora embarazada por inexistencia del subsidio por maternidad en la microempresa

La presente Investigación tuvo como objetivo demostrar que la inexistencia de regulación
del subsidio por maternidad, en el régimen especial de la microempresa regulada por el
decreto legislativo N° 1086, vulnera el derecho de protección especial a la madre que incluye
su etapa de gestación como “trabajadora embarazada”, derecho reconocido en nuestra carta
fundamental en su artículo 23° primer párrafo.
La metodología incluyó los métodos dogmático, exegético, sistemático, deductivo e
inductivo. Desde el criterio ontológico y dogmático, resulta además una vulneración a sus
derechos laborales, y una clara vulneración a la protección especial de la madre trabajadora
con su desatención, ya que nuestra carta fundamental es taxativa en cuanto a la protección
especial a la madre trabajadora. Del análisis dogmático y exegético, concluimos que con
buena intención se aplicó en forma general un régimen especial, sin embargo se omitió las
consideraciones particulares que requiere la mujer trabajadora cuando pasa al estadio de
trabajadora gestante, como es el subsidio por maternidad, que constituye una vulneración a
sus derechos constitucionales como persona, como trabajadora y como madre, además de la
vulneración de los derechos del concebido que es sujeto de derecho en todo lo que le favorece
y que resulta necesario subsanar.
Los resultados nos permiten concluir, que cuando una empresa se acoge al régimen especial
de la microempresa, esta trabajadora embarazada se encuentra asegurada en el sistema
integral de salud (S.I.S.) el cual no cuentan con el subsidio por maternidad: descanso pre y
post natal, descanso pre y post natal en caso de parto múltiple y alumbramiento de niños con
discapacidad, postergación y acumulación del descanso pre y post natal; que incluye además
el subsidio por lactancia, el permiso por lactancia, debido a que en virtud del Decreto
Supremo N° 004-2007-SA (que regula el SIS), este sistema de aseguramiento no lo
contempla, convirtiéndose así en una desprotección y vulneración al derecho de protección
especial a la madre trabajadora embarazada.
Sin embargo, respecto al derecho inalienable de la protección especial de la madre
trabajadora embarazada y a su seguridad social en salud, el Perú se suscribe a los convenios
internacionales de trabajo y de derechos humanos y lo establece en su carta fundamental,
donde en estos, son derechos concurrentes, y, todos tienen derecho a la seguridad social en
salud, a la igualdad ante la ley, las condiciones de dignidad también son para todos y por
tanto el trato de la trabajadora embarazada en el régimen de la microempresa no puede ser
distinto al de las trabajadoras embarazadas en el régimen general común, máxime si en la
carta fundamental este tipo de trabajadoras gozan de una protección especial. The objective of this Investigation was to demonstrate that the non-existence of regulation
of the maternity allowance, in the special regime of the microenterprise regulated by
Legislative Decree No. 1086, violates the right of special protection to the mother, which
includes her stage of gestation as “pregnant worker”, a right recognized in our fundamental
charter in article 23, first paragraph.
The methodology included the dogmatic, exegetical, systematic, deductive and inductive
methods. From the ontological and dogmatic criteria, it is also a violation of their labor
rights, and a clear violation of the special protection of the working mother with her neglect,
since our fundamental letter is exhaustive in terms of the special protection of the working
mother. From the dogmatic and exegetical analysis, we conclude that a special regime was
generally applied with good intentions, however the particular considerations required by
the working woman when she passes to the stage of pregnant worker were omitted, such as
the maternity allowance, which constitutes a violation of their constitutional rights as a
person, as a worker and as a mother, in addition to the violation of the rights of the conceived
person who is a subject of law in everything that favors him and that it is necessary to correct.
The results allow us to conclude that when a company takes advantage of the special
microenterprise regime, this pregnant worker is insured in the comprehensive health system
(SIS) which does not have the maternity allowance: pre and post natal rest, pre and post natal
rest in case of multiple births and delivery of disabled children, postponement and
accumulation of pre and post natal rest; which also includes the subsidy for breastfeeding,
the leave for breastfeeding, because by virtue of Supreme Decree No. 004-2007-SA (which
regulates the SIS), this insurance system does not contemplate it, thus becoming a lack of
protection and violation to the right of special protection to the pregnant working mother.
However, regarding the inalienable right of special protection for pregnant working mothers
and their social security in health, Peru subscribes to international labor and human rights
conventions and establishes it in its fundamental charter, where in these, they are concurrent
rights, and everyone has the right to social security in health, to equality before the law, the
conditions of dignity are also for everyone and therefore the treatment of the pregnant worker
in the microenterprise regime cannot be different from of pregnant workers in the common
general scheme, especially if in the basic charter these types of workers enjoy special
protection.
