The main characteristic of an employment relationship is the subordination as a result of which the
employer exercises the power of direction directing, supervising or sanctioning. However, these
powers are not absolute, but have a limit such as the right to dignity of the worker, to health and
integrity, in such a way that the employer can exercise the power of direction, but within the limits
established by the aforementioned rights.
As a root of the Covid-19 pandemic, teleworking has become a work modality that has allowed
economic activities to continue, but with many deficiencies in terms of its application, due to the lack
of regulation that develops the right to digital disconnection as a mechanism to guarantee the health
and integrity of the worker. This legal vacuum allowed employers to carry out an abusive exercise of
management power to the point of dictating provisions at any time of the day and even on weekends,
violating the maximum working day and the established working hours, for which it is necessary a
exhaustive investigation in this regard, which allows establishing criteria towards a regulation of the
right to digital disconnection and its application.
