La hipoteca como derecho real de garantía, otorga al titular de esta, las facultades de
persecución, preferencia y venta judicial del bien, por tanto, dicha garantía real viene siendo
utilizada en innumerables actos jurídicos, donde el bien inmueble queda sujeto a responder
por el incumplimiento de la obligación garantizada. De este modo, las partes en la Hipoteca
se encuentran en la situación de exigir el cumplimiento de la obligación o ejecutar la garantía
(acreedor) así como la de honrar su deuda (deudor).
El presente trabajo de investigación tiene como propósito demostrar a través del estudio de
la doctrina, jurisprudencia registral, legislación nacional y legislación comparada, que la
regulación actual del artículo 172º de la Ley N.º 26702, Ley General del Sistema Financiero,
se encuentra vulnerando a la igualdad ante la ley, debido al tratamiento privilegiado e
injustificado que se brinda a los acreedores financieros, en comparación a los acreedores
comunes, pues la no aplicación de la caducidad en sus hipotecas evidencia el ejercicio
abusivo del derecho, ya que afecta el tráfico jurídico de bienes al establecerse las
denominadas “hipotecas eternas”, trayendo como consecuencias la lenta circulación de la
economía y el poco incentivo del crédito tanto para las personas que quieran acceder a este
tipo de financiamiento como también para sus ahorristas a raíz del actuar negligente de su
acreedor. The mortgage as a real right of guarantee, grants the owner of this, the powers of prosecution,
preference and judicial sale of the property, therefore, said real guarantee has been used in
innumerable legal acts, where the real estate is subject to answer for the breach of the
guaranteed obligation. In this way, the parties to the Mortgage are in the situation of
demanding compliance with the obligation or executing the guarantee (creditor) as well as
honoring their debt (debtor).
The purpose of this research work is to demonstrate through the study of the doctrine,
registry jurisprudence, national legislation and comparative legislation, that the current
regulation of article 172º of Law No. 26702, General Law of the Financial System, is
violating to equality before the law, due to the privileged and unjustified treatment given to
financial creditors, in comparison to common creditors, since the non-application of
expiration in their mortgages evidences the abusive exercise of the right, since it affects
traffic legal property when establishing the so-called "eternal mortgages", bringing as
consequences the slow circulation of the economy and the little incentive of credit both for
people who want to access this type of financing as well as for their savers as a result of the
negligent act of your creditor.
