Con la instauración de la Nueva Ley Procesal del Trabajo Nº 29497, se buscó
desarrollar el rol protagónico del juez durante todo el proceso judicial,
principalmente en la audiencia de conciliación, en la que el juzgador se despoja de
investidura y se convierte en un conciliador facilitando la comunicación entre las
partes, obteniendo un acuerdo conciliatorio que satisface las pretensiones de
ambas partes, sin embargo si este acuerdo conciliatorio contiene cláusulas que de
su redacción no generan certeza de lo acordado y es usado en un nuevo proceso,
esto generaría un perjuicio para las partes conciliantes, nuestro estudio de
conciliación buscó determinar los criterios que debe utilizar el juez para revisar los
acuerdos conciliatorios con efecto de cosa juzgada, en un proceso distinto al de
nulidad de acuerdo previsto por la Ley 29497, para ello se utilizaron instrumentos
como encuestas, entrevistas con juristas de la sociedad civil local, lectura de
doctrina y revisión de casos judiciales desarrollados en el distrito judicial La
Libertad. Finalmente se determinará que la norma deberá establecer una
diferencian a los acuerdos conciliatorios realizados fuera de un proceso judicial y
dentro de él, en este último caso diferenciar a su vez los extrajudiciales de los
judiciales, plasmándose en una propuesta legislativa, asimismo se confirmó
parcialmente nuestra hipótesis de investigación, determinando en qué casos el
juez podrá apartarse de lo señalado en un acta de conciliación y resolver de
acuerdo a su criterio.
