Resumen
La presente investigación trata de resolver la interrogante de si al Contribuyente se
le está vulnerando su Derecho a la Libre Elección al obligarles abrir su Cuenta
Corriente de Detracciones únicamente en el Banco de la Nación, no permitiéndoles
en ningún otro Banco del Sistema Financiero. Para esta investigación se aplicó el
Método Histórico, así como las técnicas de Investigación Bibliográfica y Análisis
Documental, obteniendo como resultados que el Decreto Legislativo nº 940 es la
única norma que obliga al Contribuyente a aperturar la Cuenta Corriente de
Detracciones únicamente en el Banco de la Nación, así mismo dicha norma
contradice a la norma Principal que es la Carta Magna del Perú (La Constitución)
la cual en su artículo Nº 2 defiende el Derecho a la Libre Elección. También en los
resultados se observa que los beneficios que brinda el Banco de la Nación son
nulos y que cuenta con algunas desventajas en comparación con las Cuentas
Corrientes que brindan los demás Bancos del Sistema Financiero. En conclusión,
el obligarles a los Contribuyentes a aperturar la Cuenta Corriente de Detracciones
únicamente en el Banco de la Nación se les está vulnerando su Derecho a la Libre
Elección, derecho que le es reconocido en la Carta Magna del Perú (La
Constitución), así como también en el Código Civil y en la Ley de Protección y
Defensa del Consumidor. This investigation tries to resolve the question of whether the Taxpayer is being
violated their Right to Free Choice by forcing them to open their Withdrawal Current
Account only in the National bank, not allowing them in any other Bank of the
Financial System. For this research, the Historical Method was applied, as well as
the Bibliographic Research and Documentary Analysis techniques, obtaining as
results that Legislative Decree No. 940 is the only norm that obliges the Taxpayer
to open the Current Account of Withdrawals only in the Bank of the Nation, likewise
said norm contradicts the Main norm that is the Magna Carta of Peru (The
Constitution) which in its article Nº 2 defends the Right to Free Choice. The results
also show that the benefits provided by the National bank are null and that it has
some disadvantages compared to the Current Accounts provided by the other
Banks of the Financial System. In conclusion, forcing Taxpayers to open the
Withdrawal Current Account only in the National bank is violating their Right to Free
Choice, a right that is recognized in the Magna Carta of Peru (The Constitution), as
well as well as in the Civil Code and in the Consumer Protection and Defense Law.
