La inclusión del heredero forzoso no incorporado en la sucesión intestada a través de un nuevo asunto no contencioso notarial

Se estudió la posibilidad de incorporar un nuevo Asunto No Contencioso Notarial a los
procedimientos ya existentes en la Ley No. 26662, Ley de Competencia Notarial en Asuntos
No Contenciosos, con la finalidad que el heredero forzoso que no fue incluido en la sucesión
intestada de su causante vía notarial o judicial, pueda ser declarado como tal, y pueda
concurrir conjuntamente con los demás coherederos para acceder a la legítima de su
causante, siempre y cuando exista voluntad entre todas las partes.
Para ello, se recurrió al estudio de las fuentes doctrinarias, jurisprudenciales y trabajos de
investigación previos sobre este tema, asimismo, se practicaron entrevistas en las que se
obtuvo como resultado que es necesario incorporar un nuevo Proceso No Contencioso
Notarial que permita la incorporación del heredero excluido en sede administrativa, sin
necesidad de realizar un trámite judicial siempre y cuando exista consenso entre los
intervinientes. The possibility of incorporating a new Notarial Non-Contentious Matter into the existing
procedures in Law No. 26662, Law of Notarial Competence in Non-Contentious Matters,
was studied, with the purpose that the forced heir who was not included in the intestate
succession of his cause by notarial or judicial means, can be declared as such, and can concur
jointly with the other joint heirs to access the legitimate of the deceased, as long as there is
a will between all the parties.
To do this, the study of doctrinal and jurisprudential sources and previous research work on
this topic was used, likewise, interviews were carried out in which it was obtained as a result
that it is necessary to incorporate a new Notarial Non-Contentious Process that allows the
incorporation of the heir excluded in administrative headquarters, without the need to carry
out a judicial process as long as there is consensus among the intervening parties.
