El presente trabajo de investigación tuvo como objetivo principal determinar la viabilidad de
la ley N°30933 –“Ley que regula el procedimiento especial de desalojo con intervención
notarial” así, como su impacto en la carga procesal de los juzgados de la Corte Superior de
Justicia de la Libertad.
Debido a la controversia generada en el ámbito jurídico, hemos considerado pertinente
analizar opiniones, críticas y mayores alcances, a fin de profundizar y conocer a los
especialistas encargados de aplicar dicha ley, recurriendo así a jueces, notarios y abogados
con el objetivo de entrevistarlos para conocer si la ley N°30933 ha cumplido su formalidad y
a partir de su opinión, determinar su viabilidad y los problemas que se han suscitado desde su
vigencia.
El problema de la presente investigación radica en la viabilidad de la Ley N°30933 y de qué
manera incide en la descarga procesal jurisdiccional; asimismo, determinar si es necesaria la
intervención notarial en el proceso de desalojo, a fin de agilizar la efectiva restitución del
bien inmueble a su propietario y reducir el tiempo de duración del proceso.
Existen a la actualidad varias leyes que regulan el proceso de desalojo. La Ley N°30933 es la
cuarta que ha entrado en vigencia a partir del año 2019, introduciendo un novedoso
procedimiento especial de desalojo e intentando que estos tan tediosos procesos se resuelvan
de una manera más célere y reducir la carga procesal del juzgado, puesto que, se producirá
una verificación previa de las causales por parte del notario. The main objective of this research work was to determine the viability of Law No.30933 -
“Law that regulates the special eviction procedure with notarial intervention” as well as its
impact on the procedural burden of the Superior Court of Justice of freedom.
Due to the controversy generated in the legal sector, we have considered it pertinent to
analyze opinions, criticisms and greater scope, in order to deepen and know the specialists in
charge of applying this law, thus resorting to judges, notaries and lawyers in order to
interview them to find out if Law No.30933 has met your expectations, and based on your
opinion, determine its viability and the problems that have arisen since its entry into force.
The problem of the present investigation lies in the viability of Law No.30933 and in what
way it affects the procedural discharge; likewise, determine whether notarial intervention is
necessary in the eviction process, in order to expedite the effective return of the property to
its owner and reduce the duration of the process.
There are currently several laws that regulate the eviction process. Law No.30933 is the
fourth that has come into force as of 2019, introducing a new special eviction procedure and
trying to resolve these very tedious processes in a more efficient way and reduce the
procedural burden of the court, since, there will be a prior verification of the grounds by the
notary.
