La figura del feminicidio, es un fenómeno global que ha sido recogido en las
legislaciones penales conformando un Derecho Penal de Género, nuestro país no ha
sido ajeno a esta tendencia, materializándolo con la incorporación del artículo 108-B
en el Código Penal.
El objetivo es determinar qué tipología legislativa ha adoptado la normatividad
jurídica peruana en relación a la legislación comparada respecto al feminicidio, para
ello hemos tenido dos antecedentes principales obtenidas del repositorio de
universidades nacionales e internacionales, un estudio de la PUCP y una tesis doctoral
de la Universidad Autónoma de Barcelona; asimismo base de datos virtuales de
SciELO, DIALNET, REDALYC, PUCP y UAB, también revistas electrónicas como
Doxa, Themis, Lex, y Gaceta Penal; motivo por el que se ha usado como criterios de
elegibilidad de documentos la calidad de la fuente primaria, la especialidad del
estudio, la relación con el tema de investigación y el periodo de actualidad a 5 años de
vigencia; el método utilizado ha sido el descriptivo-comparativo; de los resultados se
ha obtenido que la figura del feminicidio en nuestra normatividad es de carácter mixta
en relación a otras legislaciones de la región; la limitación más influyente ha sido el
tratamiento psicosocial del tema.
