Criminalización del ejercicio legítimo de la protesta social a través de la figura penal de entorpecimiento al funcionamiento de los servicios públicos en el Perú

Resumen
La presente tesis, busca Determinar si el delito de entorpecimiento al funcionamiento de los
servicios públicos criminaliza el ejercicio legítimo al derecho de la protesta social en el Perú.
La investigación es de tipo cualitativa y de diseño no experimental, descriptivo explicativo.
La técnica utilizada es el análisis documental con finalidad de describir la doctrina y
jurisprudencia sobre la protesta social a nivel internacional y nacional. Los principales
resultados es que, al criminalizar el derecho a la protesta se vulnera el contenido
constitucional protegido que comprende la facultad de cuestionar de manera temporal o
periódica a través del espacio público, con un fin legítimo y pacífico que busca un cambio
del status quo. Los estándares internacionales agrupan a derechos humanos conexos a la
protesta social, que son, el derecho a la libertad de reunión pacífica, el derecho a la libertad
de opinión y de expresión, el derecho a la vida, uso de la fuerza, garantías de detención,
tortura y malos tratos y protección de defensores y defensoras de derechos humanos. El
tribunal constitucional peruano considera que la protesta social es un nuevo derecho
fundamental según la facultad que otorga la constitución para incluir nuevos derechos
fundamentales. Concluyendo que el primer párrafo del artículo 283 del delito de
entorpecimiento al funcionamiento de los servicios públicos, criminaliza ilegítimamente el
derecho a la protesta social, porque sanciona el solo hecho de estorbar o entorpece el normal
funcionamiento del transporte con cuatro a seis años de pena, no superando los criterios
sobre legitimidad y no se ajusta al contenido esencial como derecho humano.
