Resumen
La presente investigación de tesis tiene como objetivo de estudio determinar de qué manera la ejecución de los proyectos extractivos promovidos por el Estado incide en el derecho a la consulta previa de las comunidades indígenas.
Mediante el empleo de la entrevista se recurrió a expertos con la finalidad de recoger información pertinente. A través de la técnica del análisis documental se realizó el análisis de dos casos referido a consulta previa que se ha presentado antes y después de la dación de la Ley de consulta previa. Para complementar la investigación se realizó el análisis de la normativa nacional.
A través de la técnica de triangulación de métodos de recolección resultó que existe un compulsivo interés del Estado por promocionar la intervención de grupos de inversionistas en la explotación de recursos naturales, así como la intervención social en determinada comunidad solo cuando se advierte la existencia de recursos explotables.
Se concluye finalmente que la ejecución de los proyectos extractivos promovidos por el Estado incide de manera negativa en el derecho a la consulta previa de los pueblos indígenas, puesto que se soslaya la voluntad de los pueblos a su libre desarrollo, deviniendo en protestas sociales masivas con resultados funestos.
