Resumen
La presente investigación implica analizar el criterio de las ejecutorias supremas, que excluye de la jornada máxima legal de los conductores interprovinciales y de carga; y, de ese modo, terminan declarando infundada las pretensiones de reintegro e incidencia del pago de beneficios sociales, lo que genera una vulneración a los principios esenciales que tiene un trabajador, no teniendo criterios uniformes en los distritos judiciales. Este tipo de investigación se centra en la búsqueda de las características del fenómeno estudiado que le interesan al investigador, dicho sea, de los conductores interprovinciales y de carga no sujetos a fiscalización inmediata y que prestan servicios intermitentes de espera; y el no reconocimiento a un trabajo digno y al pago por labor en jornada extraordinaria en el Perú.
