Resumen
Nowadays, the Ecuadorian State is living through moments of social conjuncture, where potential changes are attended in the social unconscious, allowing the transformation and the change of the moral and religious paradigm related to the sexual diversities, achieving the incorporation of the LGBTI groups that historically has been an excluded and discriminated group.
The following research has been realized to give a new approach to the family rights of the LGBTI groups, from a gender perspective that allows the compression and humanization on current topics like civil union, the same sex marriage, the adoption inside these groups, overcoming the existing stigma.
Therefore, it begins approaching and studying the topics and concepts related to the gender identity, sex and gender diversity, sexual orientation, knowing that the lack of knowledge and precision in the concepts and terms is what takes that originates a culture of rejection and discrimination.
Afterwards, an integral analysis of the family rights is done in the international and national frame, offering to us a global idea of how this topic is handled at present from a juridical view with a gender perspective.
Finally we do a descriptive study of those offers tending to the recovery of the family rights and conclude with an approximation to social activism and the public policies put in march in favour of this topic, without forgetting to gather the positions of social key actors of the administration of justice and of the institutional environment about this topic.
