La contratación pública en el Ecuador, legislación vigente al año 2017: régimen especial y procedimientos especiales

Abstract

The present research project deals with a study and analysis of the contracts under special regime and special procedures performed by the contracting entities. It will analyze the different hiring processes in the common system, special regime, special procedures and non-common procedures of public contracting; the way in which they are carried out in contrast to the principles of public contracting in our legislation; the need and motivation of the entity to convene a hiring process; the parameters on which the entity must be directed in order to comply with the pre-contractual procedures both in the common system and in the special regime; and, the distinction of the procedures celebrated under the modality of special regime in relation to the special procedures. In addition, it will study each one of the procedures in special regime and special procedures allowed for their effective celebration, as well as the regulations that apply to each of them, establishing possible similarities and differences that currently exist.
