dc.description.abstractThis research intends to determine when the objective duty of care is violated, especially when this violation results in criminal liability within medical field; which as we know by the very nature of the activity, doctors are prone to confusion about the existence of this criminal liability. As to determine the responsibility of doctors is not only necessary the production of a harmful result, either death or injuries to the patient, but is also necessary the existence of a causal link between the result punishable under criminal law and the negligent, imprudent, reckless behavior of doctors; in conclusion the actions that violate the objective duty of care.
