Relaciones entre normas generales y normas individuales: un paralelismo entre la lingüística y la disciplina jurídica en torno al concepto de institución

Abstract

La cientificidad de la disciplina jurídica es usualmente materia de debate. Las particularidades que posee no son solo exclusivas de ella sino que en buena medida pueden ser encontradas en otras ciencias. No obstante, muchos de estos otros conjuntos de conocimientos son considerados científicos aun cuando adolecen de los mismos inconvenientes. En este trabajo se realiza un paralelismo entre la Ciencia del Derecho y la Lingüística. Para tal tarea, se parte de un presupuesto, el cual es que explorar las semejanzas y diferencias estructurales entre los objetos disciplinares de la Lingüística y de la Ciencia del Derecho es útil a fin de comprender desde una perspectiva distinta ciertos problemas que se le presentan al conocimiento jurídico a la hora de acercarse a las normas jurídicas.

The scientific characteristic of legal studies is usually under debate. The particularities that they have are not theirs exclusively but also can be found in other "sciences". However, many of these other disciplines are considered scientific even when they face the same problems. In this article I present a parallel between Legal 'Science' and Linguistics. To do so, I depart from an idea that is that to explore the structural coincidences and the differences the scientific objects of Linguistics and Legal Science is useful in order to comprehend from a new perspective the problems that are faced by the legal knowledge when it comes to approach to legal norms.
