Resumen
Los delitos de cuello blanco presentan ciertas características filosóficas y dogmáticas que, en muchos casos, contradicen principios reconocidos por el derecho penal. Esta tensión entre las características que asume el moderno derecho penal económico y los fundamentos teóricos de la disciplina se manifiesta de múltiples formas. Ello obliga a plantearse el interrogante de hasta qué punto los clásicos fundamentos del derecho penal nuclear pueden sostenerse frente a esta clase de criminalidad; más específicamente, la pregunta estriba en cómo resolver la tensión entre los principios que legitiman el castigo, que son un producto de la reflexión racional, y las prácticas punitivas en el campo del derecho penal económico, que emergen como consecuencia de los nuevos desafíos y necesidades que enfrentan en las sociedades actuales. La respuesta no puede ser global, sino que exige un análisis de cada uno de los problemas planteados en particular.
