Dignidad Humana y Justicia Social en el derecho laboral del sistema jurídico mexicano

Abstract

El presente artículo de investigación presenta un análisis del concepto Dignidad Humana positivizado en las interpretaciones jurisprudenciales de la Suprema Corte de Justicia de la Nación; mismo que a partir de la reforma en materia de derechos humanos del año 2011, ha sido interpretado de tal manera que ha provocado un cambio en la interpretación de las normas jurídicas del sistema jurídico mexicano. La argumentación que se presenta en el presente texto intenta mostrar como el concepto de Dignidad Humana se ajusta frente al de Justicia Social en la rama del derecho de laboral, con ello se intenta responder la interrogante ¿Qué repercusión tiene la concepción de Dignidad Humana con la Justicia Social en el derecho laboral del sistema jurídico mexicano? Para ello se parte del análisis de las tesis de jurisprudencia de Justicia Social y Dignidad Humana sostenidas por la Corte y el análisis de una interpretación realizada en la que se aplican conjuntamente la Dignidad Humana y la Justicia Social para resolver cuestiones procesales de un litigo de carácter laboral.

This research article presents an analysis of the concept of Human Dignity positivized in the jurisprudential interpretations of the Supreme Court of Justice of the Nation; since the human rights reform of 2011, it has been interpreted in such a way that it has led to a change in the interpretation of the legal norms of the Mexican legal system.. The argument presented in this text attempts to show how the concept of Human Dignity is in line with that of Social Justice in the branch of labour law, thereby trying to answer the question What impact does the conception of Human Dignity have on the Social Justice in the labour law of the Mexican legal system? To this end, it is based on the analysis of the thesis on the case-law of Social Justice and Human Dignity supported by the Court and the analysis of an interpretation carried out in which Human Dignity and Social Justice are applied together to resolve procedural issues of a labour dispute.
