O meio ambiente na jurispridência do Supremo Tribunal Federal : análise de alguns casos selecionados

Abstract

This study aims to evaluate the evolution of environmental law according to jurisprudence of the Supreme Court, on the premise that this Court is the guardian of the Constitution, the most important and complete legal text of environmental protection. Therefore, it started with a doctrinal and legislative analysis of the theoretical foundations of environmental law, given the expansion of protection at the international level and National Legislation. The Brazilian constitutional system, with emphasis on the 1988 Constituent Assembly, was the north for the analysis of 04 (four) relevant cases decided by the Supreme Court that allowed the assessment of the degree of importance that this Court has given to environmental law when in conflict with other interests and legal rights because, although much has been done, revealing certain evolution, much to be done to consolidate the effective protection required to the environment and thus to decent life for present and future generations.
