Resumen
This work aims to carry out an analysis of the procedural narratives in the cases of sexual gender violence. It is an inter-disciplinary research between Psychoanalysis and Law and uses as analysis material procedural records of cases legally completed which involve complaints of sexual gender violence. As methodology, we use the flanerie listening. The dialog between Psychoanalysis and Law is activated by the considerations by Felman (2014), who situates the gender violence as a cultural trauma, because of its repetitive, collective and historical character of occurrence, before which the legal field can be understood as a cultural device of elaboration and representation of the events. However, the analyzed narratives point to a difficulty of listening of the gender violence by the legal field, which result in procedural narratives that take shape of a compulsion to traumatic repetition. The feminist criminology helps in the analysis of this difficulty of listening, when denouncing the masculine character of functioning of the legal field, which reflects in the difficulty of recognition and elaboration of this violence. From this derives that the legal field cannot be effective as a device of active positioning before the gender violence.
