Implicações da redução da maioridade penal no sistema prisional brasileiro

The present work aims to promote the discussion about a very controversial and polemic issue that is the reduction of the criminal majority in Brazil, as well as to highlight its consequences for the Brazilian prison system. Starting from an analysis of the evolution of the legislation pertinent to the subject and approaching the proposal of reduction of the criminal age that is still processed in the National Congress, some aspects of this measure were exposed. Furthermore, considerations were made regarding the fulfillment of the objectives and functions originally imposed to custodial sentences, and also, there was a brief exposition of the precarious and degrading situation that the Brazilian penitentiary system is in. It is common knowledge that the structural and administrative conditions of prisons are worsening, with serious violations of fundamental rights and guarantees, as well as a great neglect of the state, which does not invest in effective improvements. Considering these expositions, through the method of deductive approach, method of monographic procedure and of the technique of bibliographical research, the analysis of this extremely important subject that is the reduction of the criminal majority was proceeded, in order to expose some of its negative implications for the Brazilian prison system. In fact, reducing the age of criminality will not reduce crime in the country; on the contrary, inserting adolescents into the current bankrupt prison system may actually worsen the existing violence scenario, so it is necessary to adopt other measures that are really effective for this fight against crime.
