dc.description.abstract | This article aims to present a study on a practice repeatedly observed in the majority of
municipalities, which is the conduct of some commercial property owners and their intended
parking for exclusive use of their customers on public sidewalks and pathways, favoring the
customers of these establishments at the expense of pedestrian citizens, causing thus the
deviation from the natural destination of driveways and sidewalks that were supposed to be
free for the pedestrian traffic, damaging the citizen walking on foot, impairing their right to go
and come, mainly for the disabled, elderly and children. Through a bibliographical research, it
was searched as if of the o improper use of the public spaces, the privative spaces in sidewalk
and strolls of common place that make it difficult the free locomotion of the pedestrians,
inquiring as the legislation in national level and local of some cities it foresees the correct
occupation of the space for the pedestrians. The public space of the cities was urgently
concluded that necessary to be thought, not only for the transit of vehicles and yes for public
interest, in rational way, aiming at the interest of all, drivers and pedestrians. | |
