Esta dissertação tem como tema a questão do direito à Educação Infantil relacionado com a configuração legislativa educacional e a obrigatoriedade da matrícula na Educação Básica a partir dos quatro anos de idade. Considera a legislação atual e a proposta do Plano Nacional de Educação (PNE 2014-2024), abordando a obrigatoriedade e a universalização da Educação Básica. Tendo como objetivo geral compreender como estão sendo construídas as condições para o atendimento da Educação Infantil pelas Redes Municipais de Ensino, dialogando com a obrigatoriedade desta etapa de ensino e a perspectiva de universalização do atendimento previstos na legislação educacional brasileira. Para tanto, a pesquisa buscou responder ao seguinte problema: Como vem sendo implementada a Política de Atendimento da Educação Infantil nas Redes Municipais de Ensino, considerando a nova demanda da legislação educacional? Desta feita, a pesquisa foi realizada através da análise documental, da realização de entrevistas semiestruturadas com gestores municipais do Agreste Pernambucano e da análise hermenêutica-dialética dos dados. As conclusões da pesquisa são que as Redes Municipais de Ensino não estão garantindo as condições adequadas para a oferta e atendimento de forma obrigatória e universalizada para as crianças de quatro e cinco anos de idade, de modo a assisti-las em boas condições de funcionamento físico e pedagógico e sim utilizando estratégias de ampliação da oferta e do atendimento dos anos obrigatórios, ou seja, a pré-escola, reduzindo o número de turmas anteriormente existentes e, consequentemente, o número de atendimentos, tendo implicação direta na oferta e atendimento de toda a Educação Infantil da Rede Municipal de Ensino.FACEPEThis dissertation has as its theme the issue of the right to Early Childhood Education related to the educational legislative configuration and the compulsory enrollment in Basic Education from the age of four. To that end, the research sought to answer the following problem: How has the Child Care Policy in the Municipal Education Networks been implemented, considering the new demand for educational legislation? This research was carried out through documentary analysis, semi-structured interviews with municipal managers from Pernambuco and the hermeneutic-dialectical analysis of the data. The conclusions of the research are that the Municipal Teaching Networks are not guaranteeing the adequate conditions for the provision and attendance in a compulsory and universalized way for the children of four and five years of age, in order to assist them in good conditions of physical functioning And pedagogical, but rather using strategies to increase the supply and attendance of compulsory years, that is, the preschool, reducing the number of previously existing classes and, consequently, the number of attendances, having a direct implication in the offer and attendance of all The Infantile Education of the Municipal Network of Education.
