“Não se separa por um parágrafo o que a vida uniu pelo afeto” : análise das estratégias discursivas na construção do sentido de família homoafetiva na ADI 4.277 e ADPF 132

A perspectiva jurídica de família, no Brasil, reconhece diversos arranjos de uniões entre os seres humanos. Partindo do fundamento constitucional da garantia de uma sociedade fraterna, pluralista e sem preconceitos, bem como do instituto jurídico da “interpretação conforme a Constituição”, o Supremo Tribunal Federal decidiu, em 2011, pelo acréscimo da união entre pessoas do mesmo sexo à expressão “entidade familiar”. Ao problematizarmos o significado lexical do termo ‘família’ no discurso jurídico, tomamos por objetivo analisar as estratégias discursivas na construção do sentido de família homoafetiva na ADI 4.277 e ADPF 132. Para o desenvolvimento deste trabalho foram extraídas questões teóricas atinentes ao direito das famílias, da literatura jurídica e sociológica, por meio de pesquisa bibliográfica. No primeiro momento desta dissertação, dedicamos a nossa atenção ao estudo das questões históricas e teóricas atinentes ao direito das famílias, explorando o perfil constitucional atual da família no Brasil, bem como a construção do sentido de família na doutrina jurídica, por meio da revisão de literatura. Em seguida, nos debruçamos acerca das representações de sexo e gênero, discorrendo sobre a hegemonia patriarcal e o heterossexismo, focalizando na Teoria Queer e os estudos de sexo e gênero. Discutimos também os direitos reprodutivos e sexuais como constituintes da esfera dos direitos humanos para a formação de uma sociedade plural e democrática. Uma vez obtidos os dados da pesquisa, analisamos o corpus a partir da sua construção, sua organização e suas funções discursivas, considerando os contextos sociais, o lugar de fala e sua influência no direito. Além do mais, abordamos a construção do discurso da família pelo Supremo Tribunal Federal por meio da análise do discurso, fundamentada na Análise do Discurso Constituinte de Dominique Maingueneau (2000). The juridical perspective of the family in Brazil recognizes various arrangements of unions between human beings. On the basis of the constitutional guarantee of a fraternal, pluralistic and unprejudiced society, as well as of the juridical institute of "interpretation according to the Constitution", the Federal Supreme Court decided in 2011 to add the union of persons of the same sex to the expression "family entity". When discussing the lexical meaning of the term 'family' in the legal discourse, we aim to analyze the discursive strategies in the construction of the sense of homoaffective family in ADI 4.277 and ADPF 132. For the development of this work, theoretical questions related to family law, juridical and sociological literature were extracted through bibliographic research. At first, we will focus on the study of historical and theoretical issues related to family law, exploring the current constitutional profile of the family in Brazil, as well as the construction of the sense of family in legal doctrine, through the revision of literature. Then we focus on the representations of sex and gender, discussing patriarchal hegemony and heterosexism, focusing both on Queer Theory and studies of sex and gender. We will also discuss reproductive and sexual rights as constituents of the human rights sphere for the formation of a plural and democratic society. Once the research data is obtained, we analyze the corpus from its construction, its organization and its discursive functions, considering the social contexts, the place of speech and its influence in the law. In addition, we approach the construction of the family discourse by the Federal Supreme Court through discourse analysis, based on Dominique Maingueneau's (2000) Constituent Discourse Analysis.
