A terceirização no contexto do ultraliberalismo global e da dualização do assalariado: o desmonte das conquistas e das garantias sociais

O estudo tem como objeto a terceirização nas relações de trabalho, avaliando-a como fenômeno do contexto contemporâneo, com a consolidação do ultraliberalismo e a dilapidação do sistema protetivo do Welfare State. Inicialmente, analisa-se as transformações do capitalismo a partir da segunda metade do século XX, de modo a contextualizar a terceirização. Na sequência, são apresentadas as visões da doutrina juslaboralista tradicional, ficando constatado que tais autores se restringem à análise dogmática de enunciados normativos sobre o tema, negligenciando e legitimando o contexto de destruição social do qual o fenômeno é consequência. Em seguida, é abordada a evolução histórica da terceirização no direito positivo brasileiro e em ordenamentos estrangeiros, onde se verifica tendência global de elastecimento da legalização do instituto. Posteriormente, o fenômeno é analisado na teoria jurídico-trabalhista crítica e na teoria social crítica. São trazidas perspectivas complexas e multidisciplinares, para demonstrar que o fenômeno se insere no contexto da dualização do assalariado, como ferramenta de implosão das relações individuais de trabalho e desmantelamento sindical. Por fim, o estudo traz proposições para enfrentamento da problemática representada pela terceirização. A principal proposta baseia-se na reafirmação da luta coletiva como ferramenta de empoderamento da classe trabalhadora. Para atenuar em curto prazo os efeitos devastadores do fenômeno, propõe-se uma hermenêutica estruturante, de modo a possibilitar uma nova compreensão jurídica do instituto, em consonância com o princípio protetor e com a vedação ao retrocesso social. CAPES The study aims at outsourcing labor relations, evaluating it as a phenomenon in the contemporary context, with the consolidation of ultraliberalism and the dilapidation of the protective system from Welfare State. Initially, it analyzes the transformations of capitalism from the second half of the twentieth century, in order to contextualize outsourcing. In sequence, the visions of the traditional jus-labor doctrine are presented, being that these authors are restricted to the dogmatic analysis of normative statements, neglecting and legitimizing the context of social destruction from which the phenomenon is consequence. Next, the historical evolution of outsourcing in Brazilian law and foreign jurisdictions is addressed, showing a global tendency to increase the legalization of the institute. Subsequently, the phenomenon is analyzed in critical labor-law theory and critical social theory. Complex and multidisciplinary perspectives are brought to demonstrate the phenomenon is embedded in the context of employee dualization as a tool for implosion of individual labor relations and union dismantling. Finally, the study brings propositions to face the problematic represented by outsourcing. The main proposal is based on reaffirmation of tcollective struggle as a tool for empowerment of working class. To mitigate in the short term the devastating effects of the phenomenon, a structural hermeneutics is proposed, in order to allow a new juridical understanding of the institute, in line with the protective principle and with the prohibition of social retrogression.
