Resumen
The objective of this study is to analyze the application and effectiveness in Brazil of the Protocols on Civil Legal Cooperation within MERCOSUR in the face of Brazilian Domestic Law. The Precautionary Measures Protocol of Ouro Preto and the Las Leñas Protocol on cooperation and judicial assistance in civil, commercial, labor and administrative concluded within MERCOSUL discipline rules and mechanisms of cooperation among member countries, especially the Las Leñas Protocol, with regard to the recognition / approval and enforcement of foreign judgments and arbitral awards. The study notes that the civil legal cooperation MERCOSUL does not prevail in Brazil by the misinterpretation of these rules in these instruments, with emphasis on Article 20 of the Las Leñas Protocol, which deals with the Extraterritorial arbitration awards and Effectiveness Reports from the Member States of MERCOSUL. The lack of legal device by applying affects their effectiveness within the Brazilian territory. In short, this is due to the attitude adopted by the STF and STJ in that important points of international agreements are not being observed in Brazil, which goes against one of the principles of the Federal Constitution, in its article 4, sole paragraph, which is the quest for integration in Latin America by extreme attachment to national sovereignty, which reflects the lack of legal certainty.
