dc.description.abstractThe thesis proposes to analyze social renting housing as an alternative for housing provision in Brazil. Considering that the lack of housing is still a reality in the country, new possibilities are envisaged in the housing scenario that do not contemplate the definitive acquisition, allowing the right to housing to be guaranteed by public housing policies for social leasing. Based on the analysis of the meaning of the house, the dwelling and the dwelling and its derivations, the legal perspective on the right to housing and the right to property and the legal implications of rent in the Brazilian scenario and the reading of some national and international experiences, as well as like the Brazilian legal system that supports the possibility of applying this type of housing provision, this thesis contemplates the possibility of social leasing as a form of housing provision. In order to carry out this research, of an eminently qualitative nature, it had as a vertex of the research the documentary analysis of Brazilian housing laws and policies, as well as the analysis of some international experiences of social rental policies from bibliography, consultation of electronic sites and official sources. The work is characterized by a conceptual reading on the right to housing, contemplating the feasibility of implementing public policy of social renting housing as a form of access to housing, but with the legal guarantees that ensure the resident the effective contemplation of their right.
