O direito penal econômico brasileiro sobre criptomoedas

Abstract

The globalization process and greater dynamics in virtual markets have brought a new type of "currency" to the whole society, specifically the so-called cryptocurrencies, bitcoin being the most popular and the pioneer. This concept emerges in the global context with the proposal to mitigate financial institutions, with direct transactions between users without resorting to intermediation. The general objective of this work is to approach about the cryptocurrency and the relation between the economic penal law, being that the specific objectives are: to explain about the evolution of the cryptocurrency, as the emergence of the first one, the bitcoin; explaining the generations of existing concerns about cryptocurrencies, as the second generation of which corresponds to the period when cryptocurrency was often treated as a form of financial pyramid; finally, clarifying about the economic penal trilemma.
