Resumen
Focused on the search for effective solutions to the Brazilian prison system, the dissertation discusses the ethical and philosophical foundations of the penalty, punitive systems and evidenced framework in Brazil and in Rio Grande do Norte and also, based on the fundamentals rights and guarantees, aims to establish the limits of the state action in duty-power to punish. For that, it approaches, initially, the constitutional set of fundamental rights as instruments to protect the individual, especially the dignity of the human person, as well as the duty-power of public security, seeking to justify such term as an objective expression of fundamental rights in order to harmonize the state activity of sanction and enforcement of penalty, effectively, and respect for the human dignity of inmates. It addresses the punitive systems, particularly the doctrines and schools of thought that influenced the Brazilian law on criminal enforcement, and historical aspects related to criminal enforcement in Brazil and the factual framework found in the state of Rio Grande do Norte, as regards the prison system, highlighting the main structural failure. Finally, it indicates some suggestions for modifying the current status in criminal country running, through the implementation of changes in the scope of activities of the Executive, Legislative and Judicial branches.
