Resumen
The present work deals with the theme of mysthanasia in the context of the COVID-19
pandemic. Mysthanasia is a miserable, painful, anticipated and preventable death, caused by
several biopsychosocial factors, due to the economic, social inequalities and vulnerabilities
faced by the most humble population. In this scenario, the mysthanasia caused by the
omission of the public power regarding the provision of health services is analyzed. The study
of the chosen theme is important to expand the discussion of deaths that are being neglected
and kept hidden without the necessary repercussions, requiring the situation to be faced by the
State and the other people who compose the community. It investigates the occurrence of this
institute in view of the limitation of the health system, which causes the relativization of
patients’ constitutional rights and guarantees during this period, justified by the reservation of
the possible. With the objective of broadening the debate to understand the occurrence of
mysthanasic deaths in this scenario of COVID-19, as well as the violation of constitutional
precepts to the detriment of the dignity of living and dying, it also aims to propose measures
for immediate confrontation through the Hospital Bioethics Commission, assisting health
professionals in the face of ethical dilemmas to provide dignified and equitable treatment
among patients. The methodology used consists of qualitative, bibliographic, descriptive
research, with a conceptual, contextual, interdisciplinary approach, using the hermeneutic
method of restrictive teleological and axiological interpretation. It is concluded that the
occurrence of mysthanasia attacks the constitutional State, since it violates fundamental
precepts imposed by the Federal Constitution of 1988.
