| dc.description | The main purpose of this paper is to propose a rhetorical understanding of what Law Theory conventionally calls a gap. To this end, it makes use of the dissoì lógoi methodology. For this reason, it initially analyzes the gap as a normative void, as the School of Exegesis would have it. Later on, it examines the concept as a logical impossibility, as argued by Hans Kelsen. And, in a third moment, it sustains, as a result of the research, that this notion is an opportunity for the construction of the legal norm. After that, the conclusion is presented. | dc.description | O presente trabalho tem como objetivo principal propor uma compreensão retórica daquilo que a Teoria do Direito convencionou chamar de lacuna. Para tanto, vale-se da metodologia do dissoì lógoi. Por isso, inicialmente, analisa a lacuna como um vazio normativo, como quer a Escola de Exegese. Posteriormente, examina o conceito como uma impossibilidade lógica, como sustenta Hans Kelsen. E, em um terceiro momento, sustenta, como resultado da pesquisa, que essa noção é uma oportunidade para construção da norma jurídica. Após o que é apresentada a conclusão.
