JUSTIÇA RESTAURATIVA: NOVAS LENTES E NOVO FOCO PARA O SISTEMA PENALRESTORATIVE JUSTICE: NEW EYES AND NEW FOCUS ON THE CRIMINAL SYSTEM Jeane Gazaro Martello[1] RESUMO: O presente trabalho versa sobre a Justiça Restaurativa e o novo foco que traz para o sistema penal, especialmente no Brasil, tomando como exemplo a experiência em Porto Alegre, capital do Rio Grande do Sul. O objetivo é demonstrar a necessidade da participação da vítima e da ressocialização do apenado, uma vez que o atual sistema de justiça, caracterizado como retributivo e punitivista, mostra-se ineficaz nesses aspectos. A Justiça Restaurativa é um meio alternativo, capaz de oferecer o acesso à justiça com mais igualdade entre as partes e com a efetiva compensação do dano sofrido pela vítima, afastando a ideia de vingança e trazendo a recomposição da comunidade e a reinserção do infrator. É demonstrado que, em nosso país, faz-se necessária a mudança de lentes dos cidadãos, para que a dificuldade cultural de aceitação do novo modelo seja superada, abandonando a divisão entre “cidadãos de bem” e “cidadão do mal”. Apresentam-se alguns limites enfrentados pela Justiça Restaurativa em seu iniciante processo no país. PALAVRAS-CHAVE: Justiça Restaurativa; Vítima; Ressocialização do Infrator. ABSTRACT: The present paper deals with Restorative Justice and the new focus that it brings to the criminal justice system, especially in Brazil, taking as an example the experience in Porto Alegre, capital of RS. The main goal is to demonstrate the need of participation of victims and resocialization of the convict, since the current system, characterized as retributive and punitive, has not been effective in these aspects. Restorative justice is as an alternative mean, capable of providing access to justice with more equality between the parties, with an effective compensation of the damage suffered by the victim, leaving behind the idea of revenge and bringing recovery to the community and reintegration of the offender. It shows that, in our country, it is necessary to change the lenses of citizens to overcome the cultural difficulty of acceptance of the new model, in order to leave behind the social division between "good citizen" and "bad citizen". We present some of the limitations faced by the Restorative Justice as a beginner process in the country. KEYWORDS: Restorative Justice. Victim.
