Considering the great demographic transition, where the balance of the age groups are transforming the population pyramid, with the reduction of the youngest and the increasing number of older people, elderly rights of elderly should be guaranteed trough legislation and public policies to an active and healthy aging. It was researched articles on the subject in order to assess the oral health of the elderly people in Brazil under its legal aspects, to identify existing shares and verify compliance of the elderly, the public services offered. It was concluded that the public dental care to the elderly is still poor in Brazil. But with the implementation of the National Oral Health Policy (2004), with the conclusion of the Brasil Sorridente program, and compliance of the legislation, the elderly may have a better quality of oral health through better structuring of services, with increased places of service of public service, and effective health education for this age group who is always willing and interested in having a good quality of life.
