This work elaborates on a little covered issue in Brazilian criminal law. The theme was object of few studies in Brazil, and this is the reason why this research is especially based on texts written in the Italian doctrine. The present article aims at exposing the traits that characterize the criminal law in countries where the real socialism was established, addressing special attention to the various institutes that characterized the Marxism-leninism criminal law, in its most important stages of evolution, as well as those which are present in the current Cuban criminal code. This work refers to the liberal criminal law, to the consequences of the emptying of the special part in the totalitarian states, and to the indispensable distinction between socialist criminal law and socialization of criminal law.
