Resumen: En este artículo se estudia el sharenting, anglisismo utilizado
para aludir a la conducta de los padres de difundir fotos y datos de sus
hijos en redes sociales on line. Se abordan sus beneficios y riesgos, y la
protección jurídica de los derechos implicados, poniendo de relieve, que
en principio es un acto lícito de ejercicio de la libertad de expresión por
parte de los padres y de disposición de la intimidad personal y familiar.
También se subraya que la tutela de los derechos personalísimos del menor
está reforzada por su situación de persona en proceso de crecimiento.
Se analizan las consecuencias de la armonización de la responsabilidad
parental y la autonomía progresiva del menor, adoptada por el ordenamiento
jurídico argentino. Por último, se interpreta que para compartir
información del hijo en redes sociales on line, es necesario contar con la
opinión del hijo menor de edad con madurez suficiente, y a partir de los 13
años, con su consentimiento. Abstract: This article studies “sharenting”, an anglicism term used to refer
to the behavior of parents who disseminate photos and data of their
children online. Its benefits, risks, and legal protection of rights are addressed,
highlighting that, at first, it is indeed an exercise of freedom of
expression by parents and the provision of personal and family privacy,
and therefore a lawful act.
The article also emphasizes the protection of rights the very minor has,
which is reinforced by the circumstance they face as a person in the process
of growth. The consequences of the harmonization of parental responsibility
and the progressive autonomy over the minor, adopted by the
Argentine legal system, are analyzed as well. Finally, it concludes that in
order to share information about the child online, it’s necessary to have
the opinion of the minor with sufficient maturity, and from the age of 13
onwards, with their previous consent.
