Resumen: En los procesos de nulidad matrimonial, la ponderación de la prueba es una tarea muy delicada que requiere respetar las pautas que la Iglesia ha establecido en orden al dictado de sentencias justas. Es indispensable tener en cuenta la intrínseca juridicidad del matrimonio y la naturaleza judicial del proceso. Es preciso revalorizar la razón para superar el relativismo y el neopositivismo canónicos. La libre apreciación de la prueba por parte del Juez requiere un fino examen racional que permita alcanzar la certeza moral requerida para dictar una sentencia que diga constar la nulidad del matrimonio en cuestión. El Magisterio pontificio acerca de la actividad judicial es abundante, rico y reiterado, y resulta vinculante para los jueces. Abstract: In the processes of matrimonial nullity, the assessment of the proof is a very delicate task that demands to respect the guidelines that the Church has established in order to dictate just sentences. It is imperative to take into account the intrinsic legality of marriage and the nature of the judicial process. It is necessary to revalue the reason to overcome canonical relativism and neopositivism. The free appraisement of the evidence on part of the Judge requires a fine rational examination that allows to reach the moral certainty required to dictate a judgment that states the nullity of the marriage at issue. The Papal Magisterium on the judicial activity is abundant, rich and reiterated and is binding on judges.
