Abstract: This article remembers that the extenuating and aggravating circumstances must be taken into account by judges regarding the canon law. If the legislator has punt them is because they obey the spirit of Canon Penal Law and then cannot be set apart in the felonies of clergymen against sixth commandment. The same happens with the judgment about the responsibility of a clergyman in these crimes. That must be done with objectivity and according to the canon law. No later legislation has ever changed this.
