Cumplimiento de las medidas provisionales dictadas por la Corte IDH por parte del Estado colombiano

El presente trabajo académico abarca un análisis sobre el cumplimiento de las medidas provisionales dictadas por la Corte IDH
por parte del Estado Colombiano, describiendo en un primer momento cada uno de los asuntos respecto de los cuales existen
órdenes del alto Tribunal, estableciendo el tipo de mandatos y las acciones desplegadas por el Estado en acatamiento a ellos, para
determinar si éste ha satisfecho sus obligaciones.
Posteriormente, se hace alusión a los mecanismos institucionales dispuestos por el Estado Colombiano para efectuar cumplimiento
a las medidas provisionales, identificando las instituciones encargadas que hacen parte de la rama ejecutiva y judicial del poder
público, enfatizando en las funciones ejercidas por ellas; información derivada de las referencias hechas por el Tribunal en las
resoluciones de medidas provisionales respecto de las respuestas emitidas por parte del Estado, las observaciones de la Comisión
IDH y los escritos de los representantes de las víctimas.
Aunado a lo anterior, se pone de presente la entidad estatal encargada de activar el andamiaje institucional para efectuar
cumplimiento a las órdenes de la Corte IDH y la necesidad de una mejor articulación interinstitucional.
Finalmente, se esgrimen los principales obstáculos institucionales que afectan el cumplimiento material de las medidas
provisionales. This academic work includes an analysis of compliance with the provisional measures issued by the Inter-American Court of Human
Rights by the Colombian State. It begins by describing each one of the matters with respect to which there are orders from the
High Court, establishing the type of mandates and the actions taken by the State in compliance with them. This, so that it may be
determine whether it has satisfied its obligations.
Subsequently, allusions are made to the institutional mechanisms provided by the Colombian State to carry out compliance with
the provisional measures. This includes; identifying the institutions in charge that are part of the executive and judicial branch of
the public power, emphasizing the functions exercised by them, information derived from the references made by the Court in the
resolutions of provisional measures regarding the responses issued by the State, the observations of the Inter-American
Commission of Human Rights, and the
writings of the victims' representatives.
In addition to the foregoing, the state entity in charge of activating the institutional framework to carry out compliance with the
orders of the Inter-American Court of Human Rights and the need for a better inter-institutional coordination is put forward.
Finally, the main institutional obstacles that affect material compliance with the provisional measures are raised.
