Este artículo revisa aspectos que son motivo de controversia judicial y que requieren ser tratados por el legislador de manera concreta para limitar las generalidades que luego, bajo la potestad reglamentaria, ponen en riesgo su aplicación, generando inseguridad jurídica. A partir de este análisis, el autor profundiza en aspectos que convendría considerar en la configuración normativa de una futura reforma pensional, a fin de limitar el activismo y la congestión judicial, el desgaste administrativo y operacional de las entidades gestoras, y mitigar la desprotección del Estado a grupos poblacionales expuestos a situaciones de desigualdad e inequidad. This paper reviews some of the main aspects that are subject of controversies within the judiciary that must be addressed by the legislature to limit ambiguities that under regulatory power, give rise to insecurity in the judicial affairs. Based on this analysis, the author aims attention at the main subjects that should be considered to define a new set of rules towards a pension reform. The latter to limit the judicial activism and delay, the administrative and operational exhaustion of managing bodies, and to reduce the levels of inequality that marginalize specific groups of people who lack of any protection from the State.
