El control fiscal en Colombia como mecanismo de anticipación del daño al patrimonio público

En la tesis se propone demostrar que el control fiscal tiene un carácter anticipativo del daño fiscal. En la primera parte, a partir de
las ideas del Profesor JUAN CARLOS PELAEZ GUTIERREZ, se desarrolla los conceptos de función anticipativa, del derecho
anticipativo en sentido amplio y en sentido estricto. En la segunda parte, se demuestra que la Constitución creó un sistema de
protección difusa del patrimonio público y optó, para lograr la eficacia, por una verdadera cultura de la anticipación. En la tercera
parte, en discusión permanente con las ideas del Profesor CAMILO PERDOMO VILLAMIL, se compartirá su demostración de la
inefectividad del control colaborativo, aunque atenuando sus argumentos, y discrepando de su propuesta por corresponder a
coadministración prohibida en Colombia. Al final del trabajo se propondrá un punto medio entre la radiografía de la postración
del control colaborativo que examinó el Profesor PERDOMO VILLAMIL y su tesis, en concepto de este escrito, extrema de
coadministración. Como los actos de corrupción, que tuvieren como finalidad mermar el patrimonio público, no constituyen ni
Administración ni ejercicio de la discrecionalidad, se mostrará que sería posible que las contralorías los impidieran en el derecho
positivo colombiano de manera anticipativa, sin que pudiera objetarse coadministración. In the thesis it is proposed to demonstrate that fiscal control has an anticipatory nature of fiscal damage. In the first part, based on
the ideas of Professor JUAN CARLOS PELAEZ GUTIERREZ, the concepts of anticipatory function, of anticipatory law in the broad
sense and in the strict sense, are developed. In the second part, it is shown that the Constitution created a system of diffuse
protection of public heritage and opted, to achieve effectiveness, for a true culture of anticipation. In the third part, in permanent
discussion with the ideas of Professor CAMILO PERDOMO VILLAMIL, his demonstration of the ineffectiveness of collaborative
control will be shared, although attenuating his arguments, and disagreeing with his proposal because it corresponds to prohibited
co-administration in Colombia. At the end of the work, a midpoint will be proposed between the image of the prostration of collaborative control that Professor PERDOMO VILLAMIL examined and his thesis, in the concept of this writing, extreme coadministration.
As the acts of corruption, whose purpose is to diminish public assets, do not constitute either Administration or
exercise of discretion, it will be shown that it would be possible for the comptrollers to prevent them in the Colombian positive law
in advance, without co-administration being able to be objected.
