Protección de datos personales de niños, niñas y adolescentes en el entorno digital

Abstract

El mundo digital llegó para quedarse. Con el pasar del tiempo hemos visto cómo internet ha transformado la forma en que vemos y percibimos el mundo. Son múltiples las bondades del internet y se podría decir que las sociedades actuales no contemplan el mundo este. En el caso de los Niños, Niñas y Adolescentes (NNA) la situación es que su mundo está completamente integrado a internet, en tanto que nacieron con él, y por lo tanto son los llamados nativos digitales, no contemplan un mundo off line. Sin embargo, y como la experiencia y la conciencia del riesgo y el peligro suelen venir con los años, los NNA en su mayoría solo advierten del entorno digital sus bondades y no los peligros y consecuencias que devienen de sus usos. En el presente documento se expone la revisión de los instrumentos normativos que existen actualmente para la protección de los datos personales de los NNA, y si éstos resultan suficientes para su efectiva protección en el entorno digital.

The digital world is here to stay. As time goes by, we have seen how internet has transformed the way in which we appreciate the world. There are many virtues offered by internet, and it can be said that the current societies do not consider a world without it. In the case of children and adolescents, their world is completely integrated to internet, as they were born in it, also known as the “digital natives”, since they cannot contemplate an off-line world. However, and as experience and consciousness of danger come along with the years, most of the children and adolescents can only notice the benefits of the digital environment, and not the dangers or consequences involved from its multiple uses. This document will expose the several legal instruments that currently exist for the protection of personal data of children and adolescents, and also if these instruments are enough for the effective protection in the digital environment.
