Ley 1542 de 2012: ¿es un instrumento eficiente para combatir la inasistencia alimentaria y la violencia intrafamiliar?

Recurriendo a la doctrina moderna del Derecho penal, la ley 1542 de 2012 se traduce en una manifestación clara por parte del Estado de aquello que se conoce lacónicamente como escape o expansión del Derecho Penal, es decir un punitivismo excesivo que regularmente está orientado a la privación de la libertad. Esa huida apresurada hacia el instrumento penal impide estudiar alternativamente otras estrategias que conduzcan a la reducción del fenómeno social criminalizado, conclusión de la que se extrae otra fundamental para este artículo: la ley 1542 de 2012 resulta ineficiente e insuficiente para combatir los delitos de inasistencia alimentaria y violencia intrafamiliar.
