Afectación del principio de presunción de inocencia frente a los efectos otorgados al pliego de cargos por el Decreto 1799 de 2000

El Estado goza de la facultad del Ius Puniendi para imponer penas y sanciones que le permitan mantener un orden social justo buscando prevenir y disuadir a los coasociados de cometer conductas que afecten
la sana convivencia. En el caso de los servidores públicos, en atención a las relaciones especiales de sujeción, el régimen de responsabilidad se agrava al establecer que la misma se atribuye por omisión o extralimitación en el deber funcional.
Sin embargo, la potestad estatal debe someterse a las garantías mínimas reconocidas universalmente para su validez y eficacia, entre ellas la presunción de inocencia, según la cual, toda persona se presume inocente mientras no se demuestre lo contrario.
Por lo tanto, no puede afectarse derechos subjetivos a los servidores públicos disciplinados al otorgarse efectos jurídicos a actos administrativos que el legislador no proveyó inicialmente y que no resuelven de fondo y en forma definitivamente su responsabilidad, como ocurre en el pliego de cargos.
