Como controlar el lavado de activos y la financiación del terrorismo en los servicios de vigilancia y seguridad privada

Cuando hablamos de Lavado de Activos y Financiación del terrorismo, el primer comentario que se genera en la sociedad Colombia e Internacional es “NARCOTRAFICO”, no obstante, y si bien es cierto se relaciona con actividades que generan dinero y gran rentabilidad como producto de actividades criminales o ilegales, de esta manera los delincuentes buscan generar escenarios para ocultar su procedencia en actividades licitas impactando la economía Colombia. Como producto de lo anterior la delincuencia busca invertir dichos dineros ilícitos en proyectos de inversión de infraestructura, en los sectores mineros, cárnicos, comerciales y servicios, ofreciendo ventajas competitivas con valores agregados no aprobados por los entes de control. En Colombia, en el artículo 323 del Código Penal, se puede ampliar el espectro a LAFT en el sentido que no se trata de un delito de narcotráfico, existen otro tipo de conductas que lo asocian como un delito conexo, como se indica: Para el ordenamiento legal colombiano es tipificado desde el punto de vista de quien "adquiera, resguarde, invierta, transporte, transforme, almacene, conserve, custodie o administre bienes que tengan su origen mediato o inmediato en actividades de tráfico de migrantes, trata de personas, extorsión, enriquecimiento ilícito, secuestro extorsivo, rebelión, tráfico de armas, tráfico de menores de edad, financiación del terrorismo y administración de recursos relacionados con actividades terroristas, tráfico de drogas tóxicas, estupefacientes o sustancias sicotrópicas, delitos contra el sistema financiero, delitos contra la administración pública, contrabando, contrabando de hidrocarburos o sus derivados, fraude aduanero o favorecimiento y facilitación del contrabando, favorecimiento de contrabando de hidrocarburos o sus derivados, en cualquiera de sus formas, o vinculados con el producto de delitos ejecutados bajo concierto para delinquir, o les dé a los bienes provenientes de dichas actividades apariencia de legalidad o los legalice, oculte o encubra la verdadera naturaleza, origen, ubicación, destino, movimiento o derecho sobre tales bienes, o realice cualquier otro acto para ocultar o encubrir su origen ilícito, incurrirá (...). La misma pena se aplicará cuando las conductas descritas en el inciso anterior se realicen sobre bienes cuya extinción de dominio haya sido declarada”. Así las cosas, se considera un hecho punible cualquier conducta descrita en el texto que antecede con las correspondientes acciones penales en el ámbito jurídico Colombiano. Ahora bien, en Colombia muchas empresas de diferentes sectores económico han sido intervenidas por casos de lavado de activos y financiación del terrorismo con grandes consecuencias económicas y reputacionales a tal punto que han tenido que cerrar sus operaciones en Colombia. Para el sector servicios y específicamente de la Vigilancia y Seguridad Privada se han presentado casos en contratación de servicios con terceros, prestación de servicios a personas naturales y/o jurídicas comprometidos en casos de corrupción y LAFT, situación que ha requerido la intervención de los entes de control y vigilancia para implementar buenas practicas basados en los referentes internacionales en las estrategias definidas por:
• Convención de Viena LA/FT, adoptado en Colombia por la Ley 67/1993.
• Convención contra la FT, adoptado en Colombia por la Ley 808/2003.
• Convención de Palermo contra la delincuencia organizada trasnacional, adoptado en Colombia por la Ley 800/2003.
• Convención de Mérida contra la corrupción, adoptada en Colombia por la Ley 970/2005.
• Recomendaciones GAFI.
Y finalmente, las disposiciones de la SUPERVIGILANCIA aplicables a sus vigilados en sus circulares 465 del 2017 y la circular externa 008 de 2011.
