La constitución política de 1991 ampara de forma general el principio de la autonomía de la voluntad privada, entendida como la facultad de las personas para adquirir derechos y contraer obligaciones, es decir; entre otras cosas para celebrar contratos. De forma particular, la ley y la constitución reconocen y aceptan la autonomía de la voluntad privada en relación a la justicia arbitral, entendida como la facultad de las partes de someter sus controversias al arbitramento.
En este sentido, el principio de la autonomía de la voluntad se consolida como el fundamenta que da origen al arbitramento, ya que es la voluntad de las partes que habilita la jurisdicción arbitral. sin embargo, dicha autonomía no es absoluta, y encuentra sus límites dentro del mismo ordenamiento jurídico interno.
En este sentido, el presente artículo de investigación tiene como objetivo principal analizar el principio de la autonomía de la voluntad privada y sus limitaciones en materia arbitral. Como objetivos específicos se tienen: i) analizar el principio de la autonomía de la voluntad a nivel nacional y sus limitaciones, y ii) analizar el principio de la autonomía de la voluntad y sus limitaciones en materia arbitral. The political constitution of 1991 covers in a general way the principle of the autonomy of the private will, understood as the faculty of the people to acquire rights and to contract obligations, that is to say; among other things to celebrate contracts. In particular, the law and the constitution recognize and accept the autonomy of the private will in relation to arbitral justice, understood as the power of the parties to submit their disputes to arbitration.
In this sense, the principle of the autonomy of the will is consolidated as the foundation that gives rise to the arbitration, since it is the will of the parties that enables the arbitration juris-diction. However, this autonomy is not absolute, and finds its limits within the same domestic legal system.
In this sense, the main objective of this research article is to analyze the principle of the autonomy of private will and its limitations in arbitration matters. The specific objectives are: i) to analyze the principle of the autonomy of the will at the national level and its limitations, and ii) to analyze the principle of the autonomy of the will and its limitations in arbitration matters.
