La justiciabilidad de los derechos de los animales. Colombia, 2015

En la actualidad, se ha venido generalizando una conciencia tendiente a reconocer un valor más importante al medio ambiente y la biodiversidad, al igual que a demandar un trato más respetuoso, de protección y conservación a los organismos vivos que conforman el ecosistema. Esta tendencia ha captado la atención de los tratadistas del derecho, y ha generado la promulgación de diversos instrumentos internacionales, la adopción de normas fundamentales en los Estados y legislaciones que se orientan hacía unas relaciones entre el ser humano y la naturaleza, de la que hacen parte los animales, regidas por el respeto de la dignidad propia de todos los seres vivos. En el caso particular de los animales, se presenta un fenómeno de activismo social que busca establecer nuevas relaciones entre los seres vivos, y ha generado una serie de cambios jurídicos en diferentes latitudes geográficas. En este momento, es posible diagnosticar que se tienen unas bases suficientes, tomadas de normas internacionales y doctrina jurídica, para determinar que es posible hablar de un sistema de los derechos de los animales, que debe ser incorporado progresivamente en los Estados, de acuerdo a su sistema de valores, y desarrollado de acuerdo al conocimiento más avanzado que se logre sobre sus capacidades vitales. La discusión ética, política, filosófica y jurídica sobre las relaciones entre el ser humano y la naturaleza ha generado una diversidad de reflexiones, de las que se destacan principalmente las perspectivas: antropocéntrica y biocéntrica. La primera le atribuye valor a la naturaleza y los animales en cuanto representen un beneficio o afectación para el ser humano, la segunda, en cambio, considera que todos los organismos vivos tienen una dignidad propia. En Colombia se manifiesta una confrontación de los valores sociales imperantes, ya que por una parte, la Constitución Política de Colombia, incorporó los derechos del medio ambiente y la 12 biodiversidad como derechos colectivos, frente a los cuales sólo se tienen deberes de protección y cuidado, y de otra parte, se hace manifiesta la necesidad de reconocer subjetividad jurídica a los animales determinada por su justiciabilidad, para generar auténticas obligaciones y un ámbito de protección mayor, y que por consiguiente, ameritaría una posición diferente en el ordenamiento jurídico interno. At present, awareness has been generalized tending to recognize a more important value to the environment and biodiversity, as well as to demand a more respectful treatment, protection and conservation to the living organisms that make up the ecosystem. This tendency has caught the attention of the agents of the law, and has generated the approval of the international instruments, the adoption of fundamental norms in the States and the legislations that are oriented to the relations between the human being and the nature, of which animals are part, governed by respect for the dignity of all living beings. In the particular case of animals, there is a phenomenon of social activism that seeks to establish new relationships between living beings, and has generated a series of medical changes in different geographical latitudes. At this moment, it is possible to diagnose that it has a sufficient basis, international norms, legal doctrine have been taken, to determine that it is possible to speak of a system of animal rights, which must be progressively incorporated into the States, of according to its value system, and developed according to the most advanced knowledge it achieves about its vital capacities. The ethical, political, philosophical and juridical discussion about the relations between the human being and nature has generated a diversity of reflections, the last ones are the perspectives: anthropocentric and biocentric. The first one attributes value to nature and animals as it represents a benefit or affectation for the human being; the second, however, considers that all organisms have their own dignity. In Colombia, a confrontation of imperative social values is manifested, since one part, the Political Constitution of Colombia, incorporated the rights of the environment and biodiversity as collective rights, against which only rights of protection and care are available, and on the other hand, there has been a need to recognize the juridical subjectivity of animals for their justiciability, for the policy of obligations and protection of the general public, and therefore, a different position in the internal legal order.
