El alcance de la cláusula de “respeto de los compromisos contractuales” en el arbitraje de inversión

Durante las últimas décadas los países han generado una apertura económica, permitiendo que actores externos inviertan en sus Estados para ampliar su economía, situación que no excluye a América latina con la inversión de extranjeros y su protección a través de tratados de libre comercio; en ella ha surgido la problemática sobre quien puede resolver los problemas de origen contractual para las partes; por ello en este artículo podrán conocer sobre un medio de solución de conflicto muy utilizado hoy en día, como es el arbitraje, entendiendo su concepto, sus principales fundamentos y características, las normas que lo regulan y la posibilidad de utilizarlo cuando un Estado o nacional de otro Estado tiene algún conflicto relativo a inversión.
La inversión que realice ese nacional extranjero sin duda debe estar protegida por una serie de convenios y mecanismos para la no vulneración de sus derechos, dichos mecanismos van a ser objeto de estudio en este artículo, así mismo como las instituciones que regulan el tema a nivel internacional como por ejemplo CIADI, encargada del arreglo de diferencia relativas a inversión entre estos dos sujetos. No obstante, se analizará las formas de conformar un arbitraje de inversión, sus requisitos y las respectivas posibilidades que otorga la materia como: el manejo del arbitraje con diferentes instituciones, la aplicación de normas determinadas por las partes, el número de árbitros, la sede y las normas procesales a aplicar. During the last decades the countries have generated an economic opening, allowing external actors to invest in their states to expand their economy, a situation that does not exclude Latin America with the investment of foreigners and their protection through free trade agreements; In it has arisen the problematic on who can solve the problems of contractual origin for the parts; So in this article you will be able to know about a means of conflict resolution that is widely used today, as is the arbitration, understanding its concept, its main foundations and characteristics, the rules that regulate it and the possibility of using it when a State or national Of another State has some conflict concerning investment. The investment made by this foreign national must certainly be protected by a series of agreements and mechanisms for the non-violation of their rights, these mechanisms will be the object of study in this article, as well as the institutions that regulate the subject at the level International, such as ICSID, responsible for the arrangement of differences relating to investment between these two subjects. However, it will analyze the forms of forming an investment arbitration, its requirements and the respective possibilities granted by the matter such as: the handling of arbitration with different institutions, the application of rules determined by the parties, the number of arbitrators, And the procedural rules to be applied
